These Terms & Conditions (“Terms”) govern your access to and use of the Asym mobile application (available on the Apple App Store and Google Play Store), the associated website and web services at asymmetriclabs.ai, and all related content, features, and services (collectively, the “Service”).
The Service is owned and operated by Asym AI Labs Pvt Ltd, a private limited company incorporated under the Companies Act, 2013, having its registered office at [REGISTERED OFFICE ADDRESS — fill before publishing] (“Company”, “we”, “us”, or “our”).
These Terms constitute a legally binding electronic contract between you and the Company under the Information Technology Act, 2000 and the Indian Contract Act, 1872. By creating an account, tapping “agree”, or otherwise accessing or using the Service, you accept these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
1. Definitions
- “Account” means the account you register on the Service.
- “Content” means all material made available through the Service, including multiple-choice questions (MCQs), tests, answer explanations, study notes and dockets, current-affairs material, audio content, images, text, and software.
- “User Content” means any material you submit to the Service, including comments, replies, content ratings, issue reports, custom tests you create, and profile information.
- “Subscription” means a paid plan granting access to premium features or Content.
- “Platform Provider” means Apple Inc. (for iOS) or Google LLC (for Android), as applicable.
2. Eligibility and Minors
2.1. You must be at least 16 years of age to use the Service.
2.2. If you are between 16 and 18 years of age, you may use the Service only if your parent or legal guardian has reviewed and accepted these Terms on your behalf and has provided verifiable consent to the processing of your personal data as described in our Privacy Policy, in accordance with the Digital Personal Data Protection Act, 2023. The parent or guardian is responsible for the minor’s use of the Service and is bound by these Terms.
2.3. By using the Service, you represent that you meet these requirements and that you are competent to contract under the Indian Contract Act, 1872, or that your parent or guardian has accepted these Terms on your behalf.
2.4. We do not knowingly permit use of the Service by persons under 16. If we learn that an Account belongs to a person under 16, or to a person under 18 without guardian consent, we may suspend or delete the Account.
3. Account and Registration
3.1. Registration. You may register and sign in using a one-time password (OTP) sent to your phone number or email, or via Google Sign-In or Sign in with Apple. You must provide accurate, current, and complete information and keep it updated.
3.2. One account. You may maintain only one Account. Accounts are personal to you and may not be sold, transferred, or shared.
3.3. Device limits. The Service may restrict the number of devices on which your Account may be active at any time (currently up to two devices per platform). We may sign out older sessions when this limit is exceeded.
3.4. Security. You are responsible for all activity under your Account and for keeping your device, phone number, and email secure. Notify us promptly at support@asymmetriclabs.ai of any unauthorised use of your Account.
3.5. Communications. By registering, you consent to receive transactional communications (such as OTPs and service notifications) by SMS, email, and push notification. You can disable push notifications in your device or app settings.
4. The Service
4.1. Asym is an exam-preparation service offering practice MCQs, previous-year questions, custom tests, study notes, current-affairs material, audio content, bookmarks, progress tracking, and AI-assisted study features.
4.2. We may add, modify, suspend, or discontinue any feature or Content at any time. Where a change materially reduces the core features of a paid Subscription during its term, Section 5.7 (refunds) applies.
4.3. The Service may be unavailable from time to time for maintenance, updates, or reasons beyond our reasonable control. We do not guarantee uninterrupted availability.
5. Subscriptions, Payments, and Refunds
5.1. Free and paid tiers. Parts of the Service are free. Premium features and Content require a paid Subscription.
5.2. Pricing. Prices, plan durations, and included features are displayed in the Service before purchase. Unless stated otherwise, prices are in Indian Rupees and inclusive of GST and other applicable taxes.
5.3. Payment processing. Payments are processed by third-party payment providers (currently Razorpay Software Pvt Ltd) or, where offered, through the in-app purchase system of your Platform Provider. We do not store your card, UPI, or bank credentials; these are handled by the payment provider under its own terms and privacy policy. Where you purchase through a Platform Provider’s billing system, that Platform Provider’s payment terms also apply.
5.4. Coupons. Coupon codes and discounts are subject to their stated conditions, may be limited per user, and may be withdrawn at any time. Misuse of coupons (including automated redemption or resale) may result in cancellation of orders and suspension of the Account.
5.5. Subscription term. Subscriptions run for the purchased duration and grant access only for that duration. Unless expressly stated at purchase, Subscriptions do not auto-renew; where auto-renewal is offered, you may cancel it at any time before the renewal date through the Service or your Platform Provider’s subscription settings, effective at the end of the current billing period.
5.6. Failed or disputed payments. Access attributable to a payment that fails, is reversed, or is charged back may be suspended until the payment is settled.
5.7. Cancellations and refunds. In accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020:
- (a) If you are charged but the Subscription is not activated, or you are charged more than once for the same order, we will refund the excess or failed charge to the original payment method within a reasonable period after verification (typically 5–7 business days after confirmation from the payment provider).
- (b) If a technical fault attributable to us prevents you from accessing the core paid features of your Subscription for a continuous period of 72 hours or more after you report it, you may request a pro-rata refund for the affected period.
- (c) Because Subscriptions grant immediate access to digital content, change-of-mind refunds are not offered once premium Content has been accessed, except as required by applicable law.
- (d) Refund requests must be sent to support@asymmetriclabs.ai from the registered email, with the order details. Purchases made through a Platform Provider’s billing system are refunded through that Platform Provider under its refund policies.
5.8. Gifting. Where the Service permits purchasing a plan for another user, the recipient’s use remains subject to these Terms, and refunds (where applicable) are made to the purchaser.
6. Intellectual Property and Licence
6.1. Our IP. The Service and all Content (excluding User Content) — including MCQs, explanations, notes, dockets, current-affairs compilations, audio, software, design, and trademarks (including “Asym”) — are owned by or licensed to the Company and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.
6.2. Your licence. Subject to these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service and Content for your own personal, non-commercial exam preparation.
6.3. Restrictions. Except as expressly permitted, you must not, and must not assist anyone else to:
- copy, reproduce, extract, scrape, crawl, or download Content, or compile it into question banks, datasets, or other collections;
- share, publish, resell, rent, or otherwise make Content or your Account available to any third party, including in coaching centres, Telegram/WhatsApp groups, or file-sharing services;
- circumvent, disable, or interfere with security, encryption, access-control, or device-limit features of the Service;
- reverse engineer, decompile, or disassemble the Service except to the extent permitted by law;
- use the Content or Service to train, fine-tune, or evaluate machine-learning or AI models;
- use any automated system (bots, scripts, scrapers) to access the Service; or
- remove or alter any proprietary notices.
6.4. Your User Content. You retain ownership of your User Content. By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, adapt, publish, display, and distribute that User Content for the purposes of operating, improving, moderating, and promoting the Service. This licence continues for content that has been shared with other users (e.g., comments) even after you delete your Account, in anonymised or de-identified form where feasible.
6.5. You represent that you own or have the necessary rights to your User Content and that it does not infringe any third party’s rights.
7. Acceptable Use and User Content Rules
7.1. In line with the due-diligence requirements of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, modify, publish, transmit, store, update, or share any information that:
- (a) belongs to another person and to which you do not have any right;
- (b) is obscene, pornographic, paedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or encourages money laundering or gambling;
- (c) is harmful to children;
- (d) infringes any patent, trademark, copyright, or other proprietary rights;
- (e) deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any misinformation or information which is patently false or misleading;
- (f) impersonates another person;
- (g) threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or incites the commission of any cognisable offence, or prevents investigation of any offence, or insults any other nation;
- (h) contains a software virus or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer resource; or
- (i) violates any law for the time being in force.
7.2. You must also not: spam or flood comment threads; post advertisements or solicitations; harass, abuse, or dox other users; post exam questions or answers in violation of any examination body’s rules; or share pirated study material.
7.3. Moderation. We may (but are not obliged to) review, moderate, remove, or restrict any User Content, and may suspend or terminate Accounts that violate this Section, with or without notice. You can report objectionable content or another user through the in-app reporting feature or by emailing our Grievance Officer (Section 13). Upon receipt of a valid complaint or a lawful order, we will act within the timelines prescribed under applicable law.
8. AI-Assisted Features
8.1. Parts of the Service use artificial-intelligence systems, including third-party large-language-model and speech providers, to generate or enhance content such as search answers, explanations, and audio.
8.2. AI output may be inaccurate, incomplete, or outdated. AI-generated material is provided for study assistance only and is not a substitute for authoritative sources or professional advice. Verify important information independently before relying on it.
8.3. Your queries to AI features, and relevant context, may be processed by third-party AI providers and logged as described in our Privacy Policy. Do not submit sensitive personal information through AI features.
9. Educational Disclaimer
The Service is a study aid. We do not guarantee any examination result, score, rank, selection, or admission. Content is prepared with care but may contain errors, and syllabi and examination patterns change; the relevant examination body’s official notifications always prevail. The Company is not affiliated with, endorsed by, or connected to the UPSC or any other examination body or government authority.
10. Termination and Suspension
10.1. By you. You may stop using the Service at any time and may delete your Account through the in-app account-deletion option or by writing to support@asymmetriclabs.ai. Deletion of your Account is handled as described in the Privacy Policy. Deleting your Account does not entitle you to a refund except as provided in Section 5.7.
10.2. By us. We may suspend or terminate your Account or access to the Service, with or without notice, if: you materially breach these Terms (including Sections 6 and 7); we are required to do so by law or a lawful order; your Account is used fraudulently; or continued provision would expose us or other users to material risk. Where practicable, we will give you notice and an opportunity to respond.
10.3. On termination, your licence under Section 6.2 ends, but Sections 6.4, 7, 9, 11, 12, 13, and 14 survive.
11. Disclaimers, Limitation of Liability, and Indemnity
11.1. Disclaimer. To the maximum extent permitted by law, the Service and Content are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
11.2. Limitation. To the maximum extent permitted by law, the Company (and its directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or examination opportunities, arising out of or relating to the Service. Our aggregate liability for all claims arising out of or relating to the Service shall not exceed the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim (or ₹1,000 if you have paid no fees).
11.3. Consumer-rights savings. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including your statutory rights under the Consumer Protection Act, 2019, or liability for fraud, gross negligence, or wilful misconduct.
11.4. Indemnity. You agree to indemnify and hold harmless the Company from and against claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your User Content, your breach of these Terms, or your violation of law or third-party rights, except to the extent caused by our own breach or negligence.
12. Third-Party Services
The Service integrates third-party services (such as sign-in providers, payment processors, cloud hosting, and AI providers) identified in our Privacy Policy. Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.
13. Grievance Redressal
In accordance with the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:

We will acknowledge your complaint within 24 hours and resolve it within fifteen (15) days of receipt (or such shorter period as applicable law prescribes for specific categories of complaints). For data-protection grievances, see also the Privacy Policy; if you are not satisfied with our response, you may approach the Data Protection Board of India or other competent authority.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory consumer-protection forum available to you under law, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms or the Service.
15. Platform Provider Terms (Apple and Google)
Where you download the app from the Apple App Store or Google Play Store, the following additional terms apply:
15.1. These Terms are concluded between you and the Company only — not with the Platform Provider. The Platform Provider is not responsible for the app or its content.
15.2. Your licence to use the iOS app is limited to a non-transferable licence to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (except as permitted for Family Sharing).
15.3. The Platform Provider has no obligation to furnish maintenance or support for the app. The Company, not the Platform Provider, is responsible for maintenance and support as described in these Terms.
15.4. In the event of the app’s failure to conform to an applicable warranty, you may (for iOS) notify Apple, and Apple will refund the purchase price of the app (if any) to you; to the maximum extent permitted by law, the Platform Provider has no other warranty obligation with respect to the app.
15.5. The Company, not the Platform Provider, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection or similar claims.
15.6. In the event of a third-party claim that the app or your use of it infringes intellectual-property rights, the Company, not the Platform Provider, is responsible for the investigation, defence, settlement, and discharge of such claim.
15.7. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms (e.g., your wireless data agreement) when using the app.
15.8. Apple and Apple’s subsidiaries (for iOS), and Google (for Android), are third-party beneficiaries of these Terms and may enforce them against you.

16. General
16.1. Changes to these Terms. We may update these Terms from time to time. Material changes will be notified through the Service (e.g., in-app notice or email) at least a reasonable period before they take effect. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Service and, if applicable, cancel your Subscription (Section 5.7 applies to any refund).
16.2. Severability. If any provision is held invalid, the remainder continues in effect, and the invalid provision is deemed modified to the minimum extent necessary to make it valid.
16.3. Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets, with notice to you.
16.4. Waiver. Failure to enforce any provision is not a waiver.
16.5. Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms shown at purchase, are the entire agreement between you and the Company regarding the Service.
